Australian Marriage Equality
has just commenced inviting employers to confirm that they
grant full recognition to the same-sex marriages of their
employees and customers and do not reclassify these marriages as domestic
partnerships, de facto relationships or something
else that they are not.
These businesses
choose to treat all their employees and customers with the same dignity and respect,
regardless of their sexuality or gender.
The 2004 amendment to the Marriage Act 1961
does not prevent employers from recognising same-sex marriages.
This was
confirmed in 2006 in advice from
the former Chief Justice of the Family Court of Australia, the
Hon Alastair Nicholson AO RFD QC, in respect of a man in a
same-sex marriage:
"...there
is nothing to stop a private employer permitting your
husband to be described as your spouse on its
documentation and I can see no legal impediment to it
doing so. Indeed it would in my view be an
appropriate step for it to take. It may be that it
takes the view that to so describe your husband could
constitute an admission by it in the event of your
marital status being relevant in proceedings against it,
but I do not think that this is so because the
description in its records could not operate to change
the law."
